Terms of Service

1. Acceptance of Terms
By paying for and/or using Nisabascribe ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
The Service lets you write text, encrypt it in your own browser, and store the resulting ciphertext on decentralized storage (IPFS, backed by Filecoin storage deals). Access is unlocked by paying with Monero. By design, the Service does not have visibility into your note content or the encryption keys you use at any point - not during upload, and not during decryption. You may also create a one-time share: a link that lets a recipient - who does not need an account - open a note exactly once, after which it is permanently destroyed for both of you.
3. Payment & Subscription
Access is granted for a fixed period starting when a qualifying Monero payment is verified on-chain. You may extend your access, before or after it lapses, by submitting a new payment along with the address and transaction ID (TXID) of a previous payment, as described on the Verify Payment page. All payments are made directly on the Monero network. Because cryptocurrency transactions cannot be reversed, all payments are final - we do not offer refunds under any circumstances, including accidental overpayment, underpayment, or change of mind.
4. User Content and Responsibility
You retain all ownership of, and are solely responsible for, any content you create, upload, or store using the Service, including content sent through a one-time share link. We do not review, monitor, endorse, or exercise editorial control over content before it is stored, and, because content is encrypted on your device before it ever reaches us, we generally have no technical ability to do so. You represent and warrant that you hold all necessary rights to any content you store or share, and that both the content and your use of the Service comply with all applicable law. You agree to indemnify and hold us harmless from any claim, damage, liability, or expense (including reasonable legal fees) arising from your content or from your use of the Service in violation of these Terms.
5. Your Responsibilities
You are solely responsible for:
- Safeguarding the encryption key for each of your notes. Each note is encrypted with the key you provide when you create it, and we never receive or store any of them - losing a note's key means permanent, unrecoverable loss of that note.
- Safeguarding your username and password. Recovery is only possible through the payment-based renewal process, which requires knowing the address and TXID of a payment you previously made.
- Any automatic-deletion period you set on a note, and use of the "wipe all notes" action. Both are irreversible once triggered: an auto-expiry date deletes a note on schedule whether or not you have read or backed it up, and wiping deletes every note you own immediately with no confirmation beyond the one prompt shown at the time.
- Delivering the master key to a one-time share's recipient yourself, through a channel separate from the link itself, since the link deliberately does not contain it. Whoever opens that link - whether the intended recipient or not, and whether or not the key entered is correct - permanently destroys the note for both of you; we have no way to distinguish an intended recipient from anyone else who obtains the link, and no way to reverse this once it happens.
- The accuracy of any Monero address and TXID you submit.
- All activity that occurs through your account.
6. Acceptable Use
You agree not to use the Service to store, transmit, or facilitate access to content that is illegal in a jurisdiction relevant to you or to us, including but not limited to material that exploits or endangers minors, infringes the rights of others, or facilitates violence or fraud. This applies equally to content sent through a one-time share link. Because the Service is built so that we cannot see the plaintext content of your notes, we generally have no practical ability to review or remove specific note content, and correspondingly limited ability to respond to legal process concerning content we cannot access. This does not exempt you from complying with applicable law. We reserve the right to disable an account or restrict the Service - including revoking access or removing the underlying encrypted object where technically possible - if we become aware of misuse through means available to us.
7. No Warranty
The Service is provided "as is," without warranties of any kind. We do not guarantee uptime, and we specifically do not guarantee the permanent availability of any note, since that depends on third-party infrastructure - the Monero network, IPFS gateways, and Filecoin storage providers - outside our direct control.
8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for loss of data, loss of funds, or other damages arising from your use of the Service, including loss caused by a lost note-encryption key, lost credentials, an auto-expiry date you set yourself, use of the wipe-all action, third-party infrastructure failure, or the irreversible nature of Monero payments.
9. Termination
We may suspend or terminate access to the Service, including expired accounts, at our discretion, including for violations of these Terms.
10. Changes to These Terms
We may revise these Terms as the Service changes. Continued use after changes are posted constitutes acceptance of the revised Terms.
11. Not Legal Advice
This page is a plain description of how the Service operates and reasonable baseline conditions for using it. It is not a substitute for legal advice, and it should not be relied on as a complete statement of your rights or obligations in your jurisdiction.
